Terms of Use

1. Agreement

By downloading or using FitAI – Virtual Try-On (“FitAI”, “the app”) you agree to these Terms. If you do not agree, do not use the app. These Terms are an agreement between you and Rifat Hossain (trading as Uplifeway), the developer of FitAI (“we”, “us”). Contact: rifat.ipe@gmail.com.

You must be at least 13 years old (16 in the EEA and UK) to use FitAI.

2. The service

FitAI uses artificial intelligence (Google Gemini) to create images showing how clothing, eyewear, necklaces and earrings could look on a person, based on photos you provide. Results are AI-generated visualisations, not photographs, and may not reflect the real fit, size, colour or appearance of an item.

3. Your account

When you first open the app, a guest account is created automatically. You can optionally sign in with Apple or Google so your credits and subscription status follow you to other devices.
If you stay a guest, deleting the app or changing devices can mean losing access to your credits. Signing in prevents this.
You can delete your account at any time in Settings → Account → Delete Account, or as described at fitai-app.web.app/delete-account. Deleting your account permanently removes your remaining credits; it does not cancel a subscription (see section 5).

4. Credits

Free credits. Every user receives 2 free credits each day, refilled at local midnight. Unused free credits do not carry over. Free credits can be used with the Flash model.
Costs. Each try-on or pose variation uses credits according to the AI model: Flash 1 credit, Flash Pro 2 credits, Pro 4 credits. Flash Pro and Pro use purchased credits only. The cost is shown before you generate.
Failed generations. If a generation fails, the credits used for it are returned to your balance automatically.
Rewarded ads. You may earn up to 3 extra credits per day by watching rewarded ads.
Credit packs are one-time (consumable) in-app purchases. Purchased credits do not expire while your account exists.
Promotional codes. We may offer codes that add credits or temporary Pro access. Codes have no cash value and may be withdrawn.
Credits have no monetary value, cannot be exchanged for cash, and cannot be transferred to another account. We may adjust credits that were obtained through error, fraud or abuse.

5. FitAI Pro subscriptions

Prices vary by country and are shown in the app before you buy. Credits from each billing period are added to your balance at the start of that period and remain available while your account exists.

Auto-renewal. Payment is charged to your Apple ID or Google Play account when you confirm the purchase. Your subscription renews automatically at the end of each period unless you turn off auto-renewal at least 24 hours before the period ends; your account is charged for renewal within the 24 hours before the period ends. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

Cancelling

iPhone / iPad: Settings → your name → Subscriptions → FitAI → Cancel Subscription.
Android: Google Play Store → profile icon → Payments & subscriptions → Subscriptions → FitAI → Cancel.

After cancelling, Pro stays active until the end of the period you have paid for. Deleting the app or your FitAI account does not cancel a subscription.

6. Payments and refunds

All purchases are processed by Apple (App Store) or Google (Google Play), and their terms and refund policies apply. We cannot issue refunds ourselves. Request a refund from Apple at reportaproblem.apple.com or from Google through Google Play. If a purchase is refunded, the credits or Pro access it provided are removed. Nothing in these Terms limits rights you have under consumer law.

7. Your photos and acceptable use

By uploading a photo you confirm that you own it or have permission to use it, and that every person in it is an adult who has agreed to their image being processed. You must not use FitAI to:

upload photos of children;
create sexual, nude or intimate imagery, or any image of a person without their consent;
impersonate, harass, defame or deceive anyone, or create misleading “deepfake” content;
infringe anyone’s copyright, trademark, privacy or publicity rights;
break the law, or try to bypass the app’s safety filters, credits, payments or security.

Photos are sent to Google’s Gemini service only to create your result and are not stored on our servers; see the Privacy Policy. Report inappropriate results with the flag button on the result screen. We may suspend or delete accounts that break these rules.

8. Generated images

You may use images generated from your own photos for personal, non-commercial purposes. You are responsible for how you use and share them. Images saved or shared from the app carry an “AI-generated · FitAI” label; do not remove it or present the images as real photographs.

9. Advertising

The free version shows ads from Google AdMob. FitAI Pro subscribers do not see ads. Your choices about ad personalisation are described in the Privacy Policy.

10. Our intellectual property

The app, its design, code, text and graphics belong to us. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, in line with these Terms and the store’s usage rules. You may not copy, modify, resell or reverse-engineer the app.

11. Changes and availability

We may change, add or remove features, AI models, credit costs or prices, and we may suspend or end the service. If we discontinue FitAI, we will give reasonable notice where possible. We may update these Terms; we will change the date above and, for significant changes, notify you where the law requires. Continuing to use the app after changes take effect means you accept them.

12. Disclaimer

The app is provided “as is” and “as available”. To the extent permitted by law, we do not promise that the app will be uninterrupted or error-free, or that AI results will be accurate or suitable for any purpose.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, and our total liability for any claim relating to the app is limited to the amount you paid for the app and in-app purchases in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

14. Termination

You can stop using FitAI and delete your account at any time. We may suspend or terminate your access if you break these Terms or misuse the service.

15. Governing law

These Terms are governed by the laws of Bangladesh, without affecting any mandatory consumer protections of the country where you live.

16. App Store and Google Play

These Terms are between you and us, not Apple or Google. Apple and Google are not responsible for the app or its content, and have no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims; we are responsible for those to the extent required by these Terms. You confirm that you are not located in a country subject to a U.S. Government embargo or listed on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of Google Play is also subject to the Google Play Terms of Service.
